IANAL but by explaining the legal tactic and establishing that “bullshit” would be a euphemism for fraud, weren’t they giving their targets grounds to sue for defamation?

Defamation requires a false statement of fact. As long as you avoid making specific claims against a person or organization the First Amendment provides a lot of legal leeway.
