A crime punishable by fine is best thought of as a license to perform the act for those with sufficient finances.
Agreed. He has to face prison time for violating the law. At the very least, he should be arrested on the appropriate charges for this blatant violation of the law.
And if he gets arrested for ‘this looks kinda hinky and might violate the law’ his lawyers will have him out in two minutes.
Perhaps so, but I’d rather see a Jack Smith type federal prosecutor try to make a solid case to show that the government takes brazen attempts to flout election laws seriously.

Sure, but Jack Smith’s indictments and investigations didn’t exactly happen overnight, either. There are ongoing election interference cases in various states from 2020. They could announce an investigation tomorrow and it would be a year before they produced a charging document.
No-one is expecting Musk to end up in prison in the next week or two. But a federal or state prosecutor just announcing that a case is in the works right now, and explaining the clear-cut violation that prompted it and the consequences if they prevail, would be a powerful statement that they take this seriously and that Musk isn’t above the law.
There is absolutely nothing – including the DOJ’s 60-day election blackout custom – preventing any prosecutor from doing that.
The timing element of such an announcement is even more pressing, because in two weeks there’s an even chance that not only will there be no chance that Musk is ever charged, but that he’ll be an official in a corrupt fascist regime.
As in so many other areas of American politics, the time to take some sort of stand within the law is now.
