Another jackass parade in the SF Bay Area today.

As an aside: the flags are getting more bizarre by the day. Theyโ€™ve already replaced most of the American flags with Trump banners and the authoritarian โ€œBlue Lives Matterโ€ flag, but I canโ€™t recall the last time I saw a flag with a picture of a flag on it (unless you count the Union Jack).

Was it the destruction of the sign which was illegal, or just the removal?

Because, I fail to see how putting up a sign is legal on public land, but not removing it. Destroying it, thereโ€™s an argument about property (maybe).

Both although the crime and penalty varies by state. As long as youโ€™re not causing a safety problem, thereโ€™s little that a local government can do to stop posting signs on public property (1st Amendment) although you can be charged with littering if you donโ€™t remove them in a timely manner after the election. Private property has different standards (for instance if you rent you can be told to take your signs down by the owner), but if you mess with a sign on private property, youโ€™re now also trespassing.

Some high level points here:
https://blogs.findlaw.com/law_and_life/2020/10/is-it-illegal-to-steal-or-vandalize-political-signs.html

Anecdote: A friend of mine worked for a county judge who was up for re-election. When the judge was walking through his neighborhood, he saw an election sign that had fallen over from a homeownerโ€™s lawn on to the sidewalk. He picked up the sign and re-mounted in the exact place it was originally. The sign was for his competitor. He was sued and almost forced to resign as a result.

Basically, just donโ€™t fuck with election signs.

Additionally- itโ€™s not legal to threaten people and their families.

Laws pertaining to putting political signs on public property vary by state as well as by county and municipalities within some states. When and where in violation of them it falls to city or county workers to remove them, not nutjobs from the opposing party making violent threats.

In the thread I linked to the poster says she was putting them up in accordance with the law, and doing so in accordance with the local campaign office. To assume otherwise would be pure speculation serving no other purpose but to play what if fallacies.

even wingnut justice hanen refused to hand the harris county g.o.p. standing to sue. 127,000 ballots will be counted.

additionally, the texas prisoner who was forced to sleep in an excrement-filled cell and then a freezing cold cell was given standing to sue the corrections officers by the supreme court. barrett took no part while clarence thomas was the only one who dissented, presumably seeing no big deal about forcing a man to sleep in a shit filled cell for 6 days-- https://www.supremecourt.gov/opinions/20pdf/19-1261_bq7c.pdf

Thomas has to sleep in his own mind every night, which is much worse.

indeed.

i wish i could copy and paste the pdf of the decision. it reads like a sequel to gilliamโ€™s brazil except itโ€™s a supreme court decision. there are times iโ€™m ashamed to be a multigenerational native of texas. reading the summary of this manโ€™s treatment at the hands of the texas prison system was one of those times.
