Was it the destruction of the sign which was illegal, or just the removal?
Because, I fail to see how putting up a sign is legal on public land, but not removing it. Destroying it, thereβs an argument about property (maybe).
Both although the crime and penalty varies by state. As long as youβre not causing a safety problem, thereβs little that a local government can do to stop posting signs on public property (1st Amendment) although you can be charged with littering if you donβt remove them in a timely manner after the election. Private property has different standards (for instance if you rent you can be told to take your signs down by the owner), but if you mess with a sign on private property, youβre now also trespassing.

Anecdote: A friend of mine worked for a county judge who was up for re-election. When the judge was walking through his neighborhood, he saw an election sign that had fallen over from a homeownerβs lawn on to the sidewalk. He picked up the sign and re-mounted in the exact place it was originally. The sign was for his competitor. He was sued and almost forced to resign as a result.
Basically, just donβt fuck with election signs.

Laws pertaining to putting political signs on public property vary by state as well as by county and municipalities within some states. When and where in violation of them it falls to city or county workers to remove them, not nutjobs from the opposing party making violent threats.
In the thread I linked to the poster says she was putting them up in accordance with the law, and doing so in accordance with the local campaign office. To assume otherwise would be pure speculation serving no other purpose but to play what if fallacies.

i wish i could copy and paste the pdf of the decision. it reads like a sequel to gilliamβs brazil except itβs a supreme court decision. there are times iβm ashamed to be a multigenerational native of texas. reading the summary of this manβs treatment at the hands of the texas prison system was one of those times.
