One way for Democrats to make clear they will not tolerate Republicans trying to fill this seat in advance of the election would be for them to pledge that, if they take the White House and Senate in November, they will increase the size of the Supreme Court to 13 justices.

I could see Cruz getting nominated, though. He seems to be despised by many of his peers in the Senate, & they would be glad to be rid of him. Ayatollah Abbott would get to name his replacement to serve the remainder of his term & I wouldn’t be surprised if Lt. Gov. Taliban Dan Patrick gets the nod. He has lusted after that job for years. Not sure if the Ayatollah get to name Taliban Dan’s replacement, or if he would need to call a special election. I haven’t studied Texas government since the Nixon regime.

Antonin Scalia died February 13, 2016… a full six months before Hillary Clinton formally got the Democratic nomination and long before most people expected Trump to win the Republican nomination. Guess what? Republicans didn’t allow Obama to appoint his successor either.
Even if Ginsberg had decided to retire earlier than she preferred out of partisan considerations (again, something a SCOTUS Justice should never feel pressured to do) then it may well have backfired and just given Trump two vacancies to fill as he entered office instead of one.
Also, saying “she undid her legacy” by having the gall to die while a Republican was in office is just gross. If Dukakis had won in '88 then I don’t think it’s reasonable to say Thurgood Marshall would have “undone his legacy” for choosing to stick around instead of retiring.
