Why were they tried in the US in the first place? Surely if, for example, a private Italian citizen kills someone in the US they are prosecuted there and not in Italy?
The US as a point of policy doesnβt allow itβs citizens to be tried and charged in international courts and wonβt extradite for war crimes charges in other countries. Asserting a right, and obligation to try its own citizens in its own courts.
Itβs usually applied to military members and current or former government officials (this is why Kissenger is still running around).
Itβs controversial, legally dodgy, and the extension of that policy to civilization contractors starting during the Bush administration is doubly so.
This particular case was already a core example of why this is bad policy. The pardon here is basically the fulfillment of a hypothetical. βIf we handle it that way war crimes can just be pardoned, and it all becomes meaninglessβ.

Unfortunately, i have seen people i have thought well of, considered intelligent and perceptive, fall down this hole. I think intelligence is not the issue. Being comfortable with the racism, sexism, omniphobia is a significant part, and a need to fit in with whatever they consider their βin-crowdβ are much bigger parts. IMHO, the biggest issue is being unable to see objective truth when it conflicts with your preconceived notions.
