This is fucking insane. This fucking template for a legal loophole has to be reevaluated and squashed. The conservatives judges, in their efforts to go ahead and let one little law ignore the constitution because they don’t like abortion, have opened up a legal plan to render the constitution literally obsolete.

If rights are rights - enumerated in the Constitution - they can’t be ignored because “technically” it isn’t the state performing the action. Who the hell would have thought that would be a slippery slope pounced on by lawyers and lawmakers? /s

And the second bill saying the quiet part out loud: " Standridge also proposed an accompanying bill that would prevent schools from requiring students to take any class that teaches “concepts relating to gender, sexual, or racial diversity, equality or inclusion.” Wow. Let’s just bury our head in the sand that people and society exist!

My prediction: this will keep going until something like CA’s new gun laws using the same template become law. This will be challenged and then the conservative judges will be forced to slap such tactics as unconstitutional. Even if one can argue the letter of the law doesn’t violate the Constitution, the spirit and outcome of the laws certainly are.

That’s good, because it’s terribly written, demonstrates a complete lack of understanding of actual consent, individual agency, and other basic bdsm concepts. Worst of all, it was boring. That said, I’m not going to judge someone for reading it and enjoying it, although I will recommend some good books on the topic. No kink shaming, please.

These laws aren’t just written to sidestep established law like Roe, they are written with the expectation of uneven enforcement and jurisprudence. Expect SCOTUS to both strike down the California gun law and uphold the OK book burning law. Expect Oklahoma courts to uphold banning of Twelfthnight and refuse to ban The Bible.

The only way out of this mess is to stack the court. And the clock is ticking.

If you’re right, that is going to destroy our judicial system. Lower courts will look at higher courts past rulings for how they should rule on a legal challenge. They will usually rule in accordance to past decisions, until there is a higher court ruling that changes how they should rule. If there is no consistent ruling it is going to enable lower courts to do whatever, which will lead to more appeals and challenges.
