And that is all that actually matters.
fuck every last christio-fascist with cactus and barbed wire.
well there’s your problem, right there /s
That’s a First Amendment challenge right there.
What’s the worst that could happen?
with the current SCOTUS?
while it most definitely IS a 1A challenge, i fear it would not go the way it obviously should, due to the SC being majority shitheads.
Bet they serve good BBQ & Hot Wings.
In terms of the outcome to the challenge (if it gets that far) it could go either way. Since this doesn’t have much of an impact on the rights of corporate “persons”, Roberts would probably join the liberal wing in finding the school’s denial of the club to be in violation of the Constitution.
And they might still be outvoted, too. He’s joined the liberals on several recent cases and they’ve lost.
The Satanic Temple is doing the Lord’s work.
If Biden and his admin gets off their asses and packs the court, that could still be a strategic win. If the current SCOTUS somehow rules so obviously against the direct and obvious wording and intent of the 1A, then that would open up a complete review of all the stupid rulings since the Burger Court by the expanded and rebalanced court. Think Citizens United, Holder, Heller, etc.
It could also be entertaining to watch them squirm and contort to come up with a justification that wouldn’t also force a reinterpretation of the 2A.
Supportive parents mentioned how the formation of the club was a constitutional right
Oh, my sweet summer child . . .
What does that mean, a recognized religion? Recognized by whom? I was gonna say Recognition sounds awfully like establishment, but I guess not necessarily.
The IRS as being exempt from income taxes?
