In terms of the outcome to the challenge (if it gets that far) it could go either way. Since this doesn’t have much of an impact on the rights of corporate “persons”, Roberts would probably join the liberal wing in finding the school’s denial of the club to be in violation of the Constitution.

If Biden and his admin gets off their asses and packs the court, that could still be a strategic win. If the current SCOTUS somehow rules so obviously against the direct and obvious wording and intent of the 1A, then that would open up a complete review of all the stupid rulings since the Burger Court by the expanded and rebalanced court. Think Citizens United, Holder, Heller, etc.

It could also be entertaining to watch them squirm and contort to come up with a justification that wouldn’t also force a reinterpretation of the 2A.
