Deadly force means that force which a reasonable person would consider likely to cause death or serious bodily harm. Pointing a gun at someone is not deadly force, pulling the trigger is. Unless they have shot, stabbed, or very badly beaten someone, no they haven’t.
Notice that word ‘only’ in there. It’s my understanding that the colonial British made overzealous accusations of treason and used it to prosecute just about any act of defiance prior to the time of the US founding. The definition of treason was specifically constrained by the founders in order to prevent its use as a generic crime that could be easily abused by the government. Time has marched on and now we might be stuck with parsing out the definition of ‘war’ to determine the extent of the crime. To me, the actions of the Bundy bunch don’t rise to that level of conflict. The non-declaration of war by the US government seems to confirm that they don’t think so either.

Okay, so at first, I was all like, “I don’t know about calling them terrorists, I mean, usually we use that for people who are actually killing or at least kidnapping (or trying actively to do so).” Then they put snipers in towers and I was like, “Okay, that seems like putting lives in the hands of the whim of some people who might think they are Rambo and creating some kind of invisible ‘you might be killed’ line, I’d be pretty nervous about that.”
But setting up a court to try people? What are they going to do to people they find guilty, restorative justice? Draw up arrest warrants, cut the power, blockade the supplies, and accept those who peacefully surrender. If we really insist on humouring them we could ask each if they want to be tried as a citizen of the united states or held as a prisoner of war.
