Dissemination of propaganda material of unconstitutional and terrorist organisations

(1) Whoever disseminates or makes available to the public in Germany or produces, stocks, imports or exports for dissemination in Germany or abroad the propaganda material
  1. of a political party which has been declared unconstitutional by the Federal Constitutional Court or a political party or organisation which has been held by final decision to be a surrogate organisation of such a party,

  2. of an organisation which has been banned by final decision because it is directed against the constitutional order or against the concept of international understanding or which has been held by final decision to be a surrogate organisation of such a banned organisation,

  3. of a government, organisation or institution outside the territorial scope of this statute which is actively pursuing the objectives of one of the political parties or organisations referred to in nos. 1 and 2 or

  4. the content of which is intended to further the activities of a former National Socialist organisation

incurs a penalty of imprisonment for a term not exceeding three years or a fine.

(2) Whoever disseminates or makes available to the public in Germany or produces, stocks, imports or exports for dissemination in Germany or abroad the propaganda material of an organisation which is listed as a person, group or entity in the Annex to Council Implementing Regulation (EU) 2021/138 of 5 February 2021 implementing Article 2 (3) of Regulation (EC) No 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism, and repealing Implementing Regulation (EU) 2020/1128 (OJ L 43, 8.2.2021, p. 1) incurs the same penalty.

(3) Propaganda material within the meaning of subsection (1) is only such content (section 11 (3)) which is directed against the free democratic basic order or the concept of international understanding. Propaganda material within the meaning of subsection (2) is only such content (section 11 (3)) which is directed against the existence or the security of a state or of an international organisation or against the constitutional principles of the Federal Republic of Germany.

(4) Subsections (1) and (2) do not apply if the act serves civic information, to prevent unconstitutional activities, to promote the arts or science, research or teaching, reporting about current or historical events, or similar purposes.

(5) If the degree of guilt is minor, the court may dispense with imposing a penalty under this provision.

Section 86a
Use of symbols of unconstitutional and terrorist organisations

(1) Whoever
  1. disseminates the symbols of one of the political parties or organisations designated in section 86 (1) nos. 1, 2 and 4 or (2) in Germany or uses them publicly, in a meeting or in content (section 11 (3)) disseminated by themselves or

  2. produces, stocks, imports or exports content (section 11 (3)) which depicts or contains such a symbol for dissemination or use in Germany or abroad in a manner referred to in no. 1

incurs a penalty of imprisonment for a term not exceeding three years or a fine.

(2) Symbols within the meaning of subsection (1) are, in particular, flags, insignia, uniforms and their parts, slogans and forms of greeting. Symbols which are so similar as to be mistaken for those referred to in sentence 1 are deemed to be equivalent to them.

(3) Section 86 (4) and (5) applies accordingly.

If a distraction, then Trump’s would be something like one of those animal adaptation survival strategies where, in the face of threats, some small, weak creature desperately puffs itself out to some outrageously larger size or ridiculous shape or busts some laugh-out-loud movements. As with Nature, Trump’s attempt can draw chuckles. Unlike Nature, Trump’s attempt is pathetic, bound to fail, and screams “loser”.
