We’ll have to wait to find out, after review by the Civilian Complaint Review Board, if indeed an affidavit was not made. The owner does not have to be arrested or convicted of a crime to have his property taken.

Only if the affidavit is confirmed as NOT made can this be labelled as ā€œrobbery.ā€

I think that there was a typo – was supposed to be been violent…

Also, I’m fairly sure the affidavit can be issued well after the seizure. Someone will surely correct me if I am wrong on this point.

I sold my motorcycle on Craigslist couple years ago to a guy who paid $5,000 cash in a stack of $100 bills rather than with a cashiers check or bank note. I asked him what he did for a living and he said he was a police officer. He was a nice guy, but the cynical side of me wondered if his stack of cash came from his precinct’s evidence locker.

I’m pretty sure the affidavit can also be created long after the fact, and conveniently dated to fit within whatever time frame is required by departmental policy.

The last sentence of the introductory paragraph (Mission and Rules) it is noted that:[quote]The Board forwards its findings to the police commissioner.[/quote]But I haven’t yet found any indication that the police commissioner has any obligation to act on the Board’s findings.
