FWIW, the judge is an Obama appointee.
Yeah I know, I looked them up.
I just find it infuriating how much of our government is built on custom and good faith. Iād really like the Democratic candidates to speak to what steps they would take to limit presidential powers and shore up Congressional authority, though I donāt suppose Iād like their answers much.
Oh! hey! We could solve this with smart contracts implemented via blockchain!
Didnāt they do just that by writing the law in the first place!!! Thatās the primary congressional power - writing the law. And the Executive Branch is supposed to enforce. And when there is some conflict between the two branches, the Judiciary is supposed to provide some sort of ā¦ oh I dunno ā¦ letās call it a check ā¦ or a balance.
Is Congress supposed to pass a new law that says āWe actually mean it about this law, that earlier law thatās still on the books is just for funzies.ā ??
The article quoted the judgeās opinion as including āit lacks authority to oversee the Presidentās day-to-day compliance with the statutory provisions.ā If a federal court doesnāt have jurisdiction over the President, who the hell does?
That question was asked and answered in the first couple of debates. The only candidates who answered the question with specifics were Warren, Sanders, and IIRC Harris.
I missed that. Honesty, I canāt tolerate much of the debates. Will look it up though; Iām curious what their stances are.
If it was good enough for civil rightsā¦
āAdvisers hoped that Secret Service moves in downtown Manchester to secure the area for the presidentās arrival would also make it harder for Democratic candidates and their supporters to transverse the stateās largest city in the hours before the primaryās first votes are cast, according to Trump campaign officials not authorized to discuss internal deliberations publiclyā¦ā

The Dem establishment have anointed their challenger in the Bronx:
Iād say itās the demonic opposite-- DJT.
I think thereās a huge chance Trump will win again, given how much cheating and other fuckery he and the Republicans are willing to commit. And as impeachment showed, getting caught doesnāt matter. And given what he was willing to do in Ukraine, surely heās up to all sorts of other underhanded, election-stealing shit.
Trumpās trying to scare others from revealing what they know about what heās done. And what heās currently doing.
I know this is not in fact a Trumpian eventā¦but I feel like this is him when someone suggests a salad for a lunch meeting.
The issue is not him cheating to win. The very real issue is him losing and choosing not to leave and making all sorts of claims and fuckery to achieve that goal. Bill Maher (I know you are not a fan of his) has been championing this possibility for a long time now. He isnāt wrongā¦I strongly suspect Nostradumbass will do everything he can to void any ālossā.
I think there is also a real issue around Trump cheating to win, or around people doing technically legal things to elect Trump despite them being obvious foul play.
Like what if the popular vote in Florida goes to the Democrats and the Florida electors vote for Trump anyway? Some states may have specific laws saying their electors must vote for the winner of the popular vote in that state, but I bet itās just tradition in a lot of places. And if it is against the law, what will happen? Will the Republican administration in Florida charge them? Is there even a penalty for failing to comply? Will the Democrats sue saying the votes must be cast the other way, and if so will Kavanaugh think they have a good case?
Iām not sure the next election will be an election even if the appointment of Trump is ritualized as an election.
That part doesnāt worry me, actually, because Iām quite certain the Secret Service and active military will be more than happy to uphold their orders to get the trespasser out so that the duly elected new president can move in. Theyāve been caught in a bad place for 3 years now, having to fulfill their duty to someone who shits on their sense of honor.
As a veteran Iāve held onto the same hope. But it still scares me.
Trump has invented a new source of funds for his wall: Redemption Money. (And totally not the military budget.)
A great opportunity for the clickbait scams:
āThis One Weird Trick lets you claim your share of illegal alien Redemption Money!ā
I donāt believe any states have that law. What youāre thinking about (I think) is the Interstate Voting Compact, where 100% of the stateās delegates will be given to whomever wins the popular vote . It doesnāt go into effect until enough states sign on where the vote will then immediately be determined by popular vote: National Popular Vote Interstate Compact - Wikipedia Currently enough states have said that they will implement it but they havenāt crossed the threshold yet.
ETA: Brain did a thing. Itās that theyāll award it based on national popular vote.
Never mind. I was thinking of something else.
