Yeah I know, I looked them up.

I just find it infuriating how much of our government is built on custom and good faith. Iā€™d really like the Democratic candidates to speak to what steps they would take to limit presidential powers and shore up Congressional authority, though I donā€™t suppose Iā€™d like their answers much.

Didnā€™t they do just that by writing the law in the first place!!! Thatā€™s the primary congressional power - writing the law. And the Executive Branch is supposed to enforce. And when there is some conflict between the two branches, the Judiciary is supposed to provide some sort of ā€¦ oh I dunno ā€¦ letā€™s call it a check ā€¦ or a balance.

Is Congress supposed to pass a new law that says ā€œWe actually mean it about this law, that earlier law thatā€™s still on the books is just for funzies.ā€ ??

The article quoted the judgeā€™s opinion as including ā€œit lacks authority to oversee the Presidentā€™s day-to-day compliance with the statutory provisions.ā€ If a federal court doesnā€™t have jurisdiction over the President, who the hell does?

That question was asked and answered in the first couple of debates. The only candidates who answered the question with specifics were Warren, Sanders, and IIRC Harris.

I think thereā€™s a huge chance Trump will win again, given how much cheating and other fuckery he and the Republicans are willing to commit. And as impeachment showed, getting caught doesnā€™t matter. And given what he was willing to do in Ukraine, surely heā€™s up to all sorts of other underhanded, election-stealing shit.

The issue is not him cheating to win. The very real issue is him losing and choosing not to leave and making all sorts of claims and fuckery to achieve that goal. Bill Maher (I know you are not a fan of his) has been championing this possibility for a long time now. He isnā€™t wrongā€¦I strongly suspect Nostradumbass will do everything he can to void any ā€œlossā€.

I think there is also a real issue around Trump cheating to win, or around people doing technically legal things to elect Trump despite them being obvious foul play.

Like what if the popular vote in Florida goes to the Democrats and the Florida electors vote for Trump anyway? Some states may have specific laws saying their electors must vote for the winner of the popular vote in that state, but I bet itā€™s just tradition in a lot of places. And if it is against the law, what will happen? Will the Republican administration in Florida charge them? Is there even a penalty for failing to comply? Will the Democrats sue saying the votes must be cast the other way, and if so will Kavanaugh think they have a good case?

Iā€™m not sure the next election will be an election even if the appointment of Trump is ritualized as an election.

That part doesnā€™t worry me, actually, because Iā€™m quite certain the Secret Service and active military will be more than happy to uphold their orders to get the trespasser out so that the duly elected new president can move in. Theyā€™ve been caught in a bad place for 3 years now, having to fulfill their duty to someone who shits on their sense of honor.

I donā€™t believe any states have that law. What youā€™re thinking about (I think) is the Interstate Voting Compact, where 100% of the stateā€™s delegates will be given to whomever wins the popular vote . It doesnā€™t go into effect until enough states sign on where the vote will then immediately be determined by popular vote: National Popular Vote Interstate Compact - Wikipedia Currently enough states have said that they will implement it but they havenā€™t crossed the threshold yet.
