So, resurrecting an account here because my old one was banned for not being active (had some issues with the email and just fixed them) but that’s an aside.

Here’s the problem with the 25th amendment.

It requires the cabinet sure, as everyone’s seen on TV. A majority agree that the president’s incompetent and sign the note. Which doesn’t immediately take effect. It has to be delivered to the Senate Pro Tem and the Speaker of the House first. THEN the Veep immediately takes effect.

That’s the part you see on TV.

The next part is one that nobody ever does on TV shows :stuck_out_tongue: The president sends a letter back to the senate pro tem and the speaker of the house. Immediately the Veep no longer has those powers and they transfer back to the President.

The veep and cabinet then have four days to send ANOTHER letter to the Senate pro tem and speaker of the house. And if they do, the entire congress will decide the matter. At that point, the congress must decide within 21 days (from the first letter), that the president is unable to do the duty… . by a 2/3rds majority. In both houses.

Impeachment takes a majority of the house and 2/3rds in the senate. It’s highly unlikely.

This would take 2/3rds of the house and 2/3rds of the senate. Why would this be more likely?

All this would do if the president is unwilling to be removed this way is make the republicans look bad, and then fail to do anything.

I’m pretty sure they did exactly this on West Wing. (Granted, there was no VP at the time and it was the president himself invoking the 25th.)
