This is definitely a thing; my mother suffered from it. Also the wandering around in the early hours of the morning. I am also not suggesting this is a diagnosis as Trump is a lot more with it than she was - he doesn’t seem to have dementia, what he does seem to have is the inner censor turned off. I wonder how many kings and presidents have had this, but just didn’t have Twitter to act as a kind of telemetry. Instead, they had someone to say “What His Majesty really meant to say was…”
I hope that SCOTUS just accepts the lower court’s unanimous decision or returns a considerably better than 4-4 against the ban. I’ll bet at least Roberts upholds the lower court, but I wouldn’t even be all that surprised if it was unanimous. Republicans don’t like Trump, and Supreme Court justices don’t have to be deferential to him to maintain their positions.
Then again, I’m not a US legal scholar, and my understanding is the SC has ruled in the past that the rights given in the constitution are just for citizens, not for people? (Maybe I just dreamed this) Anyway, for all I know it goes 5-3 in favour of Trump. The big argument of the 9th appears to be about interpreting the purpose of the order, rather than just the plain order. The order by itself probably is legal.
I’m not sure Trump can count on Gorsuch to rule with him here.
That’s part of it, but the 9th also used a lot of paper in its ruling dealing with the lack of due process available to those affected by the order.
Yeah, the key issues seem to be rather idiosyncratic to the United States, so it’s kind of beyond me what the correct ruling is, legally speaking. At any rate, the SC decision will depend on two things:
- What the law actually says
- Who is willing to “cross the aisle” (as it were) and vote for the right decisions as opposed to the pro-Trump/anti-Trump decision
Assuming the 9th goes (1) right (they sure know more about it than I do), it comes down to (2), and I think it will be better than 4-4.
