An amendment is a good idea. They might pass one that fixed it at 11 and clarifies that the senate must vote by a 55 majority to reject a judicial nomination within two weeks or it is accepted by default.

I don’t completely disagree with you, but as I see the current political climate, getting the sort of consensus needed to ratify a constitutional amendment is unrealistic. YMMV

Everyone might go along with fixing it at 9 and getting rid of senate shenanigans, even though that leaves the Dems still screwed over by the Garland thing. The issue with court packing is that once you start doing it, every time there’s a senate and president from the same party they will do it.

You really don’t think that McConnell would take Cruz’s amendment if it said “At some hypothetical point in the future if there’s a Democratic President and a Republican senate and the president nominates a supreme court justice in the last year, you won’t be allowed to just just dick with it the way you did last time”? Why wouldn’t he jump on that?

The last ratified amendment was in 1992 - and took 202 YEARS to ratify.
