We know for a fact that the State Departments email server were hacked.
We do not know if her private servers were hacked.
If anything, she kept her information safer by being out of the high-profile target that was State’s servers.
Details, details. The important part to remember is that she’s clearly GUILTY.
This article sums it up pretty well.
Espionage, per 18 USC 798. Disclosure of classified information to any unauthorized person. 10 years per offense, under the Espionage Act. Or that would be the penalty face by little people.
Thank you, that’s actually really helpful. Given that she’s been cleared multiple times of doing so, it’ll be interesting to see how the FBI justifies searching through Anthony Weiner’s emails and connecting them to this.
I’ve never heard of any person, big or small, being charged with “espionage” for unintentionally failing to maintain proper security of classified documents, especially considering that there is no evidence Hillary’s server was ever hacked by unauthorized individuals. Can you point to any cases that would establish precedent for such a charge?
I don’t know much about previous cases. I do know what I was told would happen to me, if I mishandled classified material, specifically if I were to save classified material to any sort of external drive, in order to put it on my unclassified computer. I would not need to allow anyone else to actually see the classified information. I would not need to have any nefarious reasons for transferring the files. In my case, there would be additional draconian military penalties as well.
Just having classified material on an unauthorized device is enough to establish a violation. The classified networks are not connected to the rest of the world. It is impossible to accidentally transfer classified files onto an unauthorized device.
So far as I can tell everyone in the FBI including the director is prohibited from engaging in (certain sorts of) partisan political activity since all federal employees in the executive branch are forbidden save a very short list of exceptions that includes the the Pres, VP, and a few other cabinet members.
“The president’s assessment of his integrity and his character has not
changed,” White House press secretary Josh Earnest told reporters during
the daily briefing. “The president does not believe that Director Comey
is intentionally trying to influence the outcome of an election. The
president does not believe that he is secretly strategizing to benefit
one candidate or one political party.”
I’m not saying the charges are valid (I’m not in a position to make any informed judgment at this point), just saying that very few appointed officials are excluded from the Hatch Act and Comey’s not one of them.
The White House is playing nice for sake of national stability (the President publicly chiding the head of the FBI and accusing him of secretly strategizing for the GOP would not look good).
Yeah that makes perfect sense!!!
A darkened room with concrete walls. Anthony Weiner sits tied to a chair underneath a single light bulb. Men move in the shadows…
FBI Agent: Enough Weiner, it’s time to spill the beans!!!
Weiner: You’ll get nothing out of me, COP!!!
The FBI agent punches Weiner in the face… hard
Weiner: OK, OK!!! I’ll talk!!!
Weiner: It’s true. I sent dick pics compulsively because Hilary Clinton sent emails pertaining to national security through her private mail server. YOU’VE GOT US!!!
…aaaaaand scene
Oh dear God you are sincere. I totally had you pegged as a fly by.
Welcome to Boing Boing! Since this is very obviously the first time you have ever visited this site, I recommend having a look around. Your views might be popular in other threads and topics also!
Just covering the “sing like a bird” bit…
Having heard some of Anthony Weiner’s commentaries, interviews, and stances when defending policy, I think singing is the last thing he’d do. He’s a hard-ass when he has to be.
I think his true Kryptonite would be a cute young intern at the FBI. If they tried that, he’d sing like a choirboy.
And do you think that would that also apply to you if the classified material was not properly marked as such, which, if I understand correctly what the FBI was saying when they recommended no charges be laid, was the case with all the classified emails they found?
You sir, are a bad man!
