California has no “Stop and Identify” law. Unless police have probable cause that the person may have committed a crime, there is no law that says you have to furnish ID. Using a paltry “No eating” ordinance as a basis for demanding an ID is ludicrous and there is no reason the cops couldn’t have just given him a warning. Events like this are a waste of police time.
Yep, it’s a really easy and simple way to make people trust and respect cops even less. It’s like they’re actively trying to make everyone think they’re scum.

Hey everyone - CoCo county resident here (I actually work in Contra Costa County).
BART (Bay Area Rapid Transit) is a huge issue with most of us in CoCo county as they were taking tax dollars from us for over thirty u years to extend the system out to us. They then took all the money collected and decided that since San Jose was now an important city (Silicon Valley) that they would get the BART line and we could pound sand.
So we built our own light rail system that connects to BART.
ANYWAY…BART cops are another thorn in people’s side. See, they fought to have the same power as real cops. They get to wear real police uniforms and even drive police cars. They can even cruise the freeway. Imagine being pulled over by a BART cop on the freeway, and you’re not even on the train. Yes, they have STATEWIDE jurisdiction, even though BART is limited to a few cities in the bay area.
They even fought an ordinance to get them to wear another color uniform to let people know that these are BART, not real cops you’re dealing with. Well they ARE real cops, but…really.
They even have a SWAT team armed with assault rifles. Yes, transit police with machine guns. Nope, nothing that could go wrong there…
This is absolutely insane levels of fuckery and bullshit. The next bart cop I see I am going to slam donuts into my mouth screaming, “is it illegal for me to eat your favorite food, pig?”
There’s absolutely nothing I can say other than this is completely fucking nuts and the cop should be thrown in jail for even attempting this shit

We have the same rules here in L.A., you cannot eat or drink beverages in stations as well as on the trains. (Technically you also cannot eat while waiting at a bus stop.) I am familiar with the “broken windows” theory that became popular after a claimed success in New York in the 1990’s, and as I understand it part of it is cracking down on minor infractions. (By coincidence, Chief Bratton came to Los Angeles after New York.) So I have to wonder if incidents like this are a carry over from that era.

Everything about this is fucked. There’s a don’t eat law that probably does some good, by keeping some of that area cleaner. People litter shit all over. That’s fucked. There’s also that don’t eat law that seems to be arbitrarily enforced. That’s fucked. There’s a guy eating a sandwich, probably minding his own business, yet he gets singled out, probably because he’s black. That’s fucked. Black people suffer endless bullshit from law enforcement. Fucked. There’s probably a homeless dude sleeping in a corner in the same spot. Double fucked. The sandwich police turns on his overbearing ‘fuck you, get out’ personality, instead of some dale carnegie shit. That’s fucked. Sandwich guy is like, everybody does this, fuck you faggot. the bad apple spoils the barrel as the saying goes. in bart’s case - while “normal” police at least ostensibly exist to protect my rights and property, bart police exist to protect bart’s rights and property.
that starting point is never going to yield good outcomes.
this is my point. the “security guards” at colleges are sworn police just like bart. neither group exists to serve the public, they exist to serve the institution. and yet they can carry guns, and arrest people for reasons.
it’d be better if there were specific non police, non security guard personnel for the function of monitoring the terminals and issuing tickets.
i don’t exactly believe we should get rid of all cops, but we should devolve their use so that the limited group who are cops can be well trained, well monitored, and work towards the public good.
There is a middle age white woman eating pizza on the BART train I am. I don’t see any damn BART pd harassing her even though she is doing it in view of the cameras.
I’m pretty sick of BART police. They don’t do anything for theft or harassment on the system and just end up delaying trains when they decide to pick on people of color or the homeless. And I ain’t even gotten to justice for Oscar Grant.

My guess(!) is, that this is referring to some BART regulations aing at cleaner stations, but those would not have the standard of law and justify a detention.

Actually he is both: he is Bart Police. According to BART, eating in the paid areas of stations is banned and there are multiple signs in every station stating so. The cop wanted to issue a citation (after first asking the man to cease eating, he says). For that he needs to ID a person. Not providing an ID for a citation seems to be what made the cop see sufficient reason to escalate the situation by detaining the man and eventually calling in support. To a certain extent this all seems to be according to protocol.
This makes me think that much of the discussion here is misguided: the point is not that the cop acted out of bounds, because probably he acted entirely within his capabilities or cannot be proven to not have done so.
The point here is, would a caucasian sandwich-eater in business attire be dealt with in the same manner, on average?
If a white, arab and black looking guy cut the chain of a bicycle, the white guy receives assistance, the arab guy will be met with suspicion and the black guy gets the cops called on him.
Reminds me of a case in the Hague where an intern of the International Court of Justice (!) was arrested and imprisioned for a day in consequence of taking an illegal turn while cycling. Anybody who ever has seen traffic in the Netherlands will have noticed the non-chalant handling of rules by the native population. For hecks sake, a couple of weeks ago a minister of the cabinet literally stated in an interview for nation-wide media that he does not buckle his seatbelt because is ‘kind of naughty’. The intern however got a second, in depth ‘lesson to learn’ from the publicity department of the police: they defamed her on social media, causing her to leave the country prematurely.
And so close to the 30th anniversary of the fall of the Berlin Wall too. I guess I shouldn’t be surprised that someone is nostalgic for the days of the Stasi.
Perhaps in your place of residence it is considered acceptable to stop someone whilst eating a sandwich and check their id. Not so much here.
Didn’t even happen in Singapore where two police saw me eating a doughnut on a train platform. They politely asked me to put it away. So I did.

Why should enforcing rules on a train station be a matter for the police though?
