If you’re a danger, you can be charged wile riding a bicycle, or even just walking, so I don’t really see how this is clever.

It appears he avoided a drunk driving conviction, unless they charge him with that later.
And public intoxication isn’t actually a crime everywhere, as I was surprised to learn today. Some things drunk people might tend to do are, though, such as disorderly conduct, assault, or battery.
That said, I believe it’s completely legal to arrest anyone for any reason and hold them for up to I think 48 hours without charges.
They also might be able to use whatever the local equivalent to the Baker Act or 5150 is to take you to the hospital against your will if you’re drunk enough to be a danger to yourself even if you’re not actually breaking the law.

Not in NJ. You can get a DUI while operating a wheelchair or bicycle intoxicated.
It is not clever. What it is, is HILARIOUS, especially at the time and to the other patrons.
No, still DUI. You can get a DUI on a horse, a scooter, a bicycle, a lawnmower. rollerblades, a green machine, a boat, or any other conveyance you are piloting under the influence. DUI laws are fairly uniform across the US.

“Disorderly conduct” being the catchall charge that is added to almost every arrest and means whatever the cop and prosecutor want it to mean.
And don’t get me started on the whole insanity of charging someone who is not driving with DRIVING under the influence.
