The annual gift tax threshold was $10k from 1982 to 2001. Starting in 2002, it has been increasing with inflation. For 2024 it’s $18k. But there’s also a lifetime exemption, which for 2024 is over $13MM, which Musk isn’t likely to spend on some mediocre lawyers to file a dumb lawsuit. But she may get stuck filing some gift tax returns.
FYI, the exclusion limit for individuals in 2023 is $17k.
From the IRS website:
Who pays the gift tax?
The donor is generally responsible for paying the gift tax. Under special arrangements the donee may agree to pay the tax instead. Please visit with your tax professional if you are considering this type of arrangement.
“Everyone is in favor of free speech. Hardly a day passes without its being extolled, but some people’s idea of it is that they are free to say what they like, but if anyone else says anything back, that is an outrage.”
― Winston Churchill
It’s actually $14K as of several years ago. I wanted to help a relative with a house purchase and it turned out I could gift that amount per person (her & her husband).
Was going to respond the same, but read down before posting, and here you’ve saved me the typing!
Slight correction: it’s now $18,000/year without incurring the “gift tax”.
Don’t know for sure about Federal taxes, but some states (lookin’ at you, Michigan, thanks again for going out of your way to fuck over poor people as hard as possible, Governerd) make you count that as taxable income.
You know how John Oliver had a bit where he talked about Trump scandals as being “stupid Watergate”?
I feel like Musk’s move here is “stupid Thiel Machiavellianism” or something
Ah yes - the limitless oceans of money that ex-Twitter doesn’t have.
Also, shouldn’t ‘head of business operations Joe Benarroch’ have more important things to do - like keeping his business operating?
Finally, someone in her legal team thinks they’re funny (they’re not) - from the filing:
A short time ago in a galaxy not so far away, Defendants made it clear that only one orthodoxy in thought, speech, or action was acceptable in their empire, and that those who dared to question or failed to fully comply would not be tolerated. And so it was with Carano. After two highly acclaimed seasons on The Mandalorian as Rebel ranger Cara Dune, Carano was terminated from her role as swiftly as her character’s peaceful home planet of Alderaan had been destroyed by the Death Star in an earlier Star Wars film. And all this because she dared voice her own opinions, on social media platforms and elsewhere, and stood up to the online bully mob who demanded her compliance with their extreme progressive ideology.
That sound you can hear? That’s my eyes rolling.
I mean, there could be (in lieu of war) a sideshow in disdain for people who showed disdain for Bibi’s current Conservative Gov. and the vibe between them and whoever are shards of the PLO but not Hamas. Do they get gifting bags with only half-full products? (One new jade and sapphire-encrusted black earbud. What the…)
None of us have likely seen her contract - but I wonder what ‘implied or directly stated’ promises were made to her before or during filming?
I think she’s terrible - but I wouldn’t be surprised if Disney lowballed her with grandiose promises only to yank the rug (hence the sour feelings - a staple of rightwing victimhood regardless).
Do such promises even hold water in court?
Bankrolling a lawsuit against Disney is the kind of fiscal good sense I’d expect from the guy who paid 40-odd billion for Twitter, set it on fire and drove it off a cliff. Jesus fucking Christ, but the world is so exhaustingly stupid…
Surprised?
Just read that even the extremely problematic Bill Maher decided against airing a two-hour interview he recently conducted with West for Maher’s podcast so as not to give West the benefit of a platform for his antisemitism.
Maher being Maher, he still managed to make himself look like a fucking creep even as he was taking a principled position against spreading hate:
“We were here for two hours. By the way, we had an amazing, fun time. He’s a very charming antisemite.”
So amazing! So fun! Such a charming guy!
I am not a lawyer either but you cannot have a contract that commands you to agree to something in the future. Agree to agree…not in our legal system.
And yet I just finished negotiating my way out of just such a contract.
… by what?
IANAL
But every time I’ve asked a lawyer a question like that, the answer is “It depends…”. I imagine that’s the answer here too.
