Kacsmaryk, Ho and Wilson are all appointees of former President Donald Trump. Elrod was appointed to the 5th Circuit by former President George W. Bush. All of the judges have a history of supporting abortion restrictions.
Elrod’s opinion Wednesday said the full revocation of FDA’s approval of the drug was likely barred by legal time limits. Ho argued that the approval violated the 19th century Comstock Act.

It also seems plain and obvious that if a suit is brought only by certain Christian groups, based on their religious wishes, that restrictions on that basis are prima facie violations of the Establishment Clause.

Without the protection of being a SC Justice, this could land him in prison. Just being a federal appeals court judge doesn’t make you immune to bribery charges.

I hope they keep fighting. There’s a whole lot wrong with that ruling even outside of the inherent problem of restricting abortion access. Firstly, WV clearly does not have the right to restrict interstate commerce, so cannot stop sales of the approved drug from outside of the state. Second, mifepristone has important applications outside of abortion. Blocking sales and use of it completely violates the ACA and is much like blocking the use of forceps in the state because they might be used in an abortion.
