Elrod’s opinion Wednesday said the full revocation of FDA’s approval of the drug was likely barred by legal time limits. Ho argued that the approval violated the 19th century Comstock Act.

I hope they keep fighting. There’s a whole lot wrong with that ruling even outside of the inherent problem of restricting abortion access. Firstly, WV clearly does not have the right to restrict interstate commerce, so cannot stop sales of the approved drug from outside of the state. Second, mifepristone has important applications outside of abortion. Blocking sales and use of it completely violates the ACA and is much like blocking the use of forceps in the state because they might be used in an abortion.
How long until they just start locking up pregnant people?
