Itā€™s not like this will hold up in court. Just like with the first half dozen iterations of the ā€œMuslim ban,ā€ heā€™s already screwed himself in court by declaring his intentions.

Itā€™s pretty clearly unconstitutional to bypass Congress to get funding for a pet project. The argument that itā€™s an emergency is completely derailed by the fact that heā€™s been talking about it for almost 3 years, that it has been a big piece of his negotiation with Congress on the funding bill, and, ya know, every statistic on the topic that it is possible to gather.

The emergency declaration will provoke a resolution of disapproval from Democrats in the House which McConnell will be obligated to bring to the floor in the Senate. Thatā€™s going to put a lot of Republicans on the record one way or the other, with neither position giving them much cover.

Itā€™s a power grab for sure, probably unconstitutional, and I hate it, but Iā€™ll be darned if Iā€™m not going to enjoy some popcorn while Mitch McConnell squirms.

No. He doesnā€™t care at all about ratings. The only thing he cares about is ā€œprovingā€ that he is the most powerful and wonderful thing in the room, and he is capable of anything to ā€œproveā€ that, no matter how illegal, immoral, or insane. In that case the next Democrat Presidentā€™s first executive order of their term will declare that due to some emergency (itā€™s January and itā€™s cold in Washington DC?) effective immediately the size of the Supreme Court is increased to whatever size will give the Democrat President a majority and the following people are appointed to the Court. Then the newly inflated Court would rule on whether or not the Presidentā€™s emergency declaration is constitutional. Guess how the newly appointed justices would vote?

Executive order #2 of their term will be related to gun violence, climate change, or health care, whichever is most likely to antagonize Republicans in general and Mitch McConnell in particular (assuming heā€™s still around.)

Looks like itā€™s through the senate now. If he changes his mind again, heā€™ll have to actually veto it.

Itā€™s unlikely the house changes to something different from whatā€™s already passed like they did last time.

Iā€™m not sure he knows how to veto something instead of getting others to save him from having to do that.
