Let me be clear, this is a license to kill. I provide care for some trans kids who have been rejected from other practices and have seen the damage this kind of shit does. Allowing oppressed groups to be denied care on the basis of their group, openly and proudly is a violation of every medical ethic I can think of. And this: ā€œan anesthesiologist who refused to participate in an abortion and objected to referring a patient seeking one to another doctor when he refused to participate.ā€ Not only will I refuse to provide this care, I will obstruct the ability to access another caregiver who would. :face_with_symbols_over_mouth::face_with_symbols_over_mouth:

My profession should reject this out of hand, but I fear it will not.

The actual published rule is a tangle of legalese and references to other rules and past religious freedom law, so I canā€™t really parse the content of this ruling; news stories about it focus on examples like abortion and assisted suicide, but will this rule also protect, say, a PCP who doesnā€™t like gay people or a nurse whose ā€œconscienceā€ tells them they canā€™t care for a trans kid? As someone whoā€™s been kicked out of a doctorā€™s office because of the former, I want to know how fucked up this is.

Donā€™t get me wrong, of courseā€¦ his racism and misogyny is a real problem, too. But when Trump seriously proposed him for this seat, anyone with 2 brain cells to rub together should have laughed him out of the roomā€¦ Not to mention as soon as Trump decided that was his economic adviserā€¦ But white men get to fail up, as long as they are confident and act like they know what of they speak.

Trump only works with the best people. Heā€™d never nominate someone who isnā€™t fluent in multiple forms of awfulness.

I am interpreting it (IANAL) in relation to past ā€œreligious freedomā€ laws. As such, I fully expect your fears will be fully realized. We are already seeing this here in regards to trans and gay kids. As a pediatrician, abortion is not something I deal with, but birth control is, and things like Plan B are subject to ā€œfreedom of religionā€ for pharmacists. We have practices here that will fire trans patients as soon as they are out (or outed.) We may be the only ā€œtrans-friendlyā€ practice in the area. I am not sure this will actually change the legal landscape, but I suspect it will raise the profile and encourage those who wish to practice their ā€œfreedomsā€ to do so.

Iā€™m always a little bit at a loss when someone who is grossly unqualified bows out after it is revealed they are grossly unqualified. Like they must have some shame or some idea that the public thinking your are incompetent is somehow harmful to you.

And if they have thatā€¦ how did Trump nominate them in the first place?

The unifying feature of Trump and his fellow travelers is that they are all impervious to shame. I assume his nominees are bowing out because the numbers canā€™t be made to equal confirmation, though both Moore and Cain have displayed abundant innumeracy in the past, so who knows.

Most judges would see this as the unconstitutional end-around that it is (much like the fake border ā€œemergencyā€). The Executive doesnā€™t get to get rid of a law it doesnā€™t like. It either needs to execute the law or get Congress to change it. The courts usually look unfavorably on actions by DOJ to undermine a passed law.

Yep, itā€™s definitely a problem of social norms where if youā€™re white and in the right income bracket you can pretty much be a flake but if youā€™re anyone else itā€™s ā€œPROVE YOURSELFā€ time. Itā€™s wild, really.
