Free market dogma enabled Disney to control the area as a private fiefdom and sabotage DeSantis’s efforts to take control. He didn’t expect the leopards of Libertarianism to eat his face.

Tough to do without becoming an illegal “Bill of Attainder”. A law which targets a specific individual or group for punitive actions. Disney lawyers will be all over that with injunctions in a heartbeat.

I mean Disney isn’t being accused of or punished for a crime, though… so I doubt it’d be seen as a bill of attainder. Legislatures create special districts/sections focusing on groups and businesses all the time and have different tax measures covering them (or in some cases, not covering them, like major arena funding :frowning: )

They are being penalized and specifically targeted for negative actions by the state. Disney’s lawyers will play it up as one when they file for injunctions against the measures.

And they aren’t set up to be punitive in nature. They are done in COOPERATION with groups and businesses. Not as a way of attacking their interests.

FTFY. I doubt even any of the past communities like Golden Oaks or future communities like Cotino don’t/won’t have gates and fences and some sort of passage control, despite some of the public elements. People in Florida who can afford living “better” don’t joke around.

When we drove down to Florida in 2016, the toll roads (at least the Turnpike) didn’t accept EZPass (they have their own Sun Pass) and did pay-by-plate. There wasn’t much signage with prices, either.The tolls weren’t too high, at least.

If I understand the Florida Statutes around toll roads:

  • Any tolls collected would first go toward paying off the bonds issued for those roads. That’s currently paid by Disney.
  • Once the bonds are paid off, excess toll revenue goes towards maintaining those roads. That would also benefit Disney.
  • Any excess beyond that goes to the county.

So the governor is threatening Disney with … having tourists and taxpayers pay for their road maintenance? Am I missing something?
