DOJ: “No, we have no idea why it seems to smell of piss.”

Probably that way when they confiscated it.

Yeah, but now it smells of different piss!

The headdress, okay.
The spear? Nope. Weapon used in the commission of a crime. Forfeit it.

I would send it back with the helpful note “The headdress absolutely does not have 37 bedbugs living in it.”

But just in case, we have repeatedly sprayed it with a very powerful toxic chemical with a long-lasting residue effect, to ensure no future reappearance (of the bugs, of course).

Now, he has moved for the return of his property seized and still held by the government, including his spear and helmet

They should add a 38th bug to surveil him as there is a less than zero chance he has learned his lesson and won’t be plotting sedition all over again.

I mean, fur does need to be stored properly or it can get bugs or the hair will fall out.

Anyway, as despicable as this guy is, I don’t like civil forfeiture. If it is no longer any sort of evidence, it should be returned.

Would it be okay to return Nazi memorabilia to a convicted Nazi, if used in the commission of a crime?

The moral justification for refusing to return the asshole’s hat is clear.

The legal justification, maybe not so much.

Wouldn’t that just serve to glorify the shithead’s actions?

Not necessarily. An exhibit on the threats the United States has faced, such as the war of 1812, the civil war, and the orange insurrection could all serve as a warning and reminder that the US’ democratic governance is neither inevitable nor guaranteed.

General Lee’s saber at his surrender or a confederate uniform don’t necessarily glorify the confederacy. This dumbass’ hat shouldn’t either.

I think elevating this asshole to the status of General Lee—who for all his many faults was an accomplished military tactician—would still be giving him far too much respect.

So that’s why Jamiroquai didn’t want it back, I would consider QAnon piss as an insurance write off too.

Really dancing around calling a spear a spear and thus a weapon.
