Most of the old anti crossdressing laws were overturned on first amendment grounds. I think in Florida too.
The level of review required for restrictions on clothing is strict scrutiny- they have to show the highest level of governmental interest to prevail. And that interest canβt just be to restrict expression.
During the drafting of the Constitution they considered sumptuary laws - laws that restricted clothing - but did not include them. The Founders intent was to not restrict freedom of expression in clothing. I think George Mason wanted to restrict it.
Legal historian Katrina Rose - a lawyer with a doctorate in history- had written more law review articles on trans legal history than anyone who I can think of - but remains not well known. Because sheβs a Cassandra and some in national orgs tried to silence her.
