that’s really only ever been the rule for cis straight white people.
and previously the law was on their side, because the us has a long history of constraining the rights of women, of gay people, and people of color.
the majority of people have grown to understand though that the constitution allows broad protection of human rights, and so some of those laws got reversed. meaning now now the right needs new arguments to bring those laws back
and that’s where the article @anon67050589 posted comes in. whether it’s ‘common good constitutionalism’ or some other thing, it sounds like they’re hunting around for new justifications to reverse the last 50ish years of progress
