Between this story, and Thomas siding with the liberals on the CFPB case, I think between Alito and Thomas, Alito is the worse of the two. I think his main motivation is resentment over not being named Chief Justice, though. Originally, Roberts was supposed to replace Sandra Day OāConnor, and there have long been rumors that Alito was in line to be the next Chief Justice when Rehnquist retired. But then Rehnquist died, and Bush put Roberts in as Chief Justice and named Harriet Miers to replace OāConnor. I guess he either felt Alito wasnāt ready yet, or too controversial. Of course, the Miers nomination was a disaster, and so then Bush nominated Alito, who was a controversial nominee. His confirmation vote was 52-48, with 4 conservative Democrats joining all Republicans to confirm him. I donāt think heās ever gotten over not getting a shot at Chief Justice, and I think he kind of just wants to burn it all down from the inside.
