So if it were a crime, would it not follow that there would have to be punishment of some kind? Thatā€™s really all that makes something a crime and not just a taboo. Thatā€™s not to say that; that would be a stupid-ass law to create, but that was the question.

Perhaps the punishment could be ā€œHard Laborā€

Isnā€™t this just the logical conclusion of a ban on abortion? The alternative is that abortion is illegal, but there are no penalties for conspiring to commit a crime. The second statement where he says that women who procure illegal abortions are just victims isnā€™t internally consistent. Under this scheme, they could be victims in a way, but they would still also be criminals unless they were coerced into having an illegal abortion.
In actuality, the way I see it those women would be victims of an unjust law. My own opinion is that abortion should be freely available within limitations based on gestation, but that those limitations could be overridden in certain circumstances and there should be wide powers of discretion for the woman and her clinician. My point is that this isnā€™t really news. The position is implied in any ban on abortion. And if you think we should ban things but not have any penalties for breaking the bans, then I think you donā€™t know how laws work. But Iā€™m not a lawyer.

Itā€™s possible to ban abortions without punishing the person who was pregnant.

For example, you generally donā€™t punish (legally speaking) a minor for getting tattooed. You punish the person who tattooed them.

Perhaps part of the rampant misconception that humanity has ever not had abortions?

In any case, itā€™s terrifying to think that anyone is going to be punished for medically safe abortions (doing unlicensed ones in an area where licensed ones are reasonably available should continue to be illegal as they are today).

In their defence, it was inevitable. After constantly declaring Bill Clinton a draft dodger, it was standard operating procedure that Republican candidates to follow would be draft dodgers.

You know, just like how Republicans demonized Carter for not getting rid of the deficits he inherited, and for big government in general. Naturally, once in power, Reagan ran up record deficits and grew the government, as did Bush I and II.

Republicans declared Obama not a Christian and declared him ineligible for the White House because his father was born in another country. They declared ObamaCare to be commie Marxist socialism. Then they nominated a Mormon whose father was born in Mexico, and who had successfully implemented ā€œObamaCareā€ in his own state. Others claim that Obama wasnā€™t born in the US and that he was a communist. Now the leading ā€œrealā€ Republican was born in Canada to a man who helped Castro gain power.

If Trump wins the election, you can expect him to nuke the American diplomatic compound in Benghazi.

So if a minor is impregnated through rape or incest you punish the man responsible but keep the abortion ban? And forcing the kid to have the baby is simply declared ā€œnot punishment?ā€

Oh. Right. Rick Santorum tells us that a baby conceived through rape is a ā€œgift from Godā€ that you ā€œmust accept.ā€

That was the one. It was hearing the portion with his parents that really gave some clue as to Alexā€™s thought processes: this is his version of rebellion, but within a parameter that letā€™s him stay true to something that did get him out of a bad situation and gave him love (although not complete acceptance, of course.)

Maybe Iā€™m taking this wrong but Iā€™m not arguing for medically safe abortions by qualified medical practitioners to be banned.

Iā€™m simply stating that it is possible to ban abortions without punishing the person who received the abortion.

Abortion should be legal. It should be more legal than it is today. It should be federally funded for anyone who doesnā€™t have the money to pay for one and every hospital that receives federal funding should be required to perform them on request and no one should be allowed (or required) to pressure anyone to carry a pregnancy to term.

It would be possible to only punish the provider, there are other laws that work this way.

Prostitution is the first example I can think of, it varies from place to place whether only the prostitute can be arrested, only the ā€œjohnā€ can be arrested, or whether both can be arrested.

It can easily be illegal to sell something but not illegal to buy it.

Not to say he wouldnā€™t act on it, to pander to his audience, but I kind of doubt he actually believes many of those right-wing positions, or has ever thought about them, which is why he screws them up when he tries to parrot them. Heā€™s chosen an audience that will never realize that, though.
